Robert Dear found incompetent to stand trial

COLORADO SPRINGS, Colo. — Admitted Planned Parenthood shooter Robert Dear has been found incompetent to stand trial.

Judge Gilbert Martinez made the ruling Wednesday afternoon.

“Competency is a determination of the defendant’s current mental status,” said District Attorney Dan May. “Nobody has said that he is permanently incompetent.”

In an 8-page outline, Judge Martinez highlighted Dear’s delusional disorder – mainly revolving around the fears of an FBI conspiracy against him.

The case against Dear will be put on hold while he undergoes treatment at the Colorado Mental Health Institute, a psychiatric hospital designed to restore his competency. The court will review his progress in 90 days.

However, May believes the defense failed in showing Dear’s inability to continue.

“Our contention was they did not meet their burden,” he said. “It was the burden on the defense to show he is incompetent at this time and it was our contention that that had not been established.”

Every 90 days, the state hospital must report back to the court on Dear’s status of competency – a process that could take weeks, months or even years.

“We would anticipate this case – like others of this type – are not a quick timeline” said May.

After the ruling was announced, Dear called Martinez “prejudiced” and a “filthy animal.”

Dear is charged with 179 counts, including murder, attempted murder and assault, in the November 27 shootings.

In courtroom outbursts, Dear has said he is guilty and called himself a “warrior for the babies.”

In the competency hearing that spanned two days and concluded Tuesday, psychologists testified Dear isn’t mentally capable of understanding the court proceedings or helping his lawyers.
