Update on the Fountain officer involved shooting

FOUNTAIN, Colo. — An update has been given on the officer involved shooting that took place on Sept. 24.

As a result of the investigation, an additional male was arrested on the suspicion of first degree burglary, attempted motor vehicle theft, possession of a handgun juvenile and attempted theft.

Investigators also downloaded and reviewed the footage from each of the Fountain officer’s body worn camera and discovered the footage did not capture the events leading up to and the discharge of Officer Kay’s weapon.

Officers were dispatched to 775 Legend Oak Dr. in reference to an unknown situation that came in as an auto theft and changed to a disturbance in progress. Officer Kay was met outside of the home by a visibly upset and frantic mother who was waving and beckoning the officer into her home. Officer Kay then attempted to activate his body camera as he exited the vehicle and followed the mother into her residence.

Once inside, the situation was frantic and rapidly evolving. Within a minute after calling out on scene, Officer Kay radioed that shots had been fired and requested medical. He then realized his camera had not been activated and reactivated his camera with all recordings captured after that point.

Fountain officers are equipped with body worn cameras, but they must press and hold the on button to begin recording. Department policy indicates officers should not compromise their safety or anyone else’s in order to turn on the cameras, however the recorder should be activated as soon as practicable.

The investigation is still ongoing. Updates will be given as information is released.
