Citizens United can run ads for conservative film

The Colorado Secretary of State’s Office says a conservative group can run ads promoting its film about Colorado politics.

The Denver Post reports that Citizens United can still face court complaints alleging the advertisements for “Rocky Mountain Heist” are attack ads, not a means of reporting news. The movie is about people the group says have influenced Colorado’s political swing to the left over the past decade.

A federal appeals court last week ruled that Citizens United can air the film without disclosing its financers. But the 10th U.S. Circuit Court of Appeals also said the Secretary of State can decide if ads qualify as electioneering requiring disclosure.

Citizens United says it plans to spend $170,000 on TV ads and $40,000 on online promotions before the Nov. 4 election.
